ACCEPTANCE OF LIABILITY

• The person/s responsible for the account, (hereafter “the responsible person”) as set out in this agreement for continuation/admission in Mitchell’s Plain Music Academy or Kraaifontein Academy of Music herewith assumes liability for the account, alternatively binds him/herself as co-debtor and surety for payment of all school fees to Mitchell’s Plain Music Academy or Kraaifontein Academy of Music.

• The guardian/Next of kin, as described in this agreement binds him/herself as surety and co-debtor for the payment of all school fees by the responsible person or any other payments that may arise from this agreement.

TERMS OF PAYMENT

​

• It is accepted that the monthly tuition fees for 2022 is R380,00 Yearly Registration Fee and R399.99 Monthly Tuition Fee.

• Tuition fees for 11 months (February – December) are payable on or before the first of each month in advance by the responsible person in this application

• This is an ongoing contract, meaning, should the student be absent due to any reason, you will still be responsible for tuition fees during the period of absence.

• Payments can be made via direct deposit, Internet or debit order into the academies account without any deductions. Proof of payment must be emailed or handed in at the academy. NO CASH PAYMENTS

• All fees must be paid upfront. The academy reserves the right to charge a admin fee of R35,00 per day should fees not be settled by the 3rd of every month.

• Before any learner commences with his/her first class at Mitchell’s Plain Music Academy or Kraaifontein Academy of Music they are required to pay registration fee and the starting months fee, only then will the student be able to start with his/her classes.

• When registering yourself, or your child/ren at Mitchell’s Plain Music Academy/Kraaifontein Academy of Music, you need to pay R380,00 registration fee. All payments are non-refundable once paid into the schools account.

BREACH OF CONTRACT

 

In the event where the undersigned surety, responsible person or guardian commits a breach of contract of any of the term of this agreement, the academy may in its sole discretion:

• Claim damages from the responsible person and/ or the sureties and guardian or

• Refuse the student entry to the Academies premises until the breach has been remedied

• Take whatever legal steps that may be necessary

LEGAL FEES

 

In the event where the academy takes legal action against the responsible person he/she will be held liable for all legal fees on an attorney client scale, collection costs and commission and tracing fees.

GENERAL

 

This Agreement constitutes the whole agreement between the parties relating to the subject matter hereof. No amendment or consensual cancellation of this Agreement or any provision or term thereof or of any Agreement, bill of exchange or other document issued or executed pursuant to or in terms of this Agreement and so settlement of any disputes arising under this Agreement and no extension of time, waiver or relaxation or suspension of any of the provisions or terms of this Agreement or of any Agreement, bill of exchange or other document issued pursuant to or in terms of this Agreement shall be binding unless recorded in a written document signed by the parties. Any such extension, waive or relaxation or suspension which is so given or made shall be strictly construed as relating to the matter in respect whereof it was made or given.

CANCELLATION

 

• The responsible person undertakes to give one month written notice of termination of the enrollment of a student. Failing which the liability be incurred for the full amount of the following months fees.

• Mitchell’s Plain Music Academy/Kraaifontein Academy of Music shall be entitled to terminate the Enrollment of any student under the following circumstances:

  • If the student is guilty of an offence, which, in the sole opinion of the Academy renders his/her continued enrollment at the Academy impossible, in which event the responsible person, after deduction of all amounts otherwise owing to the Academy will be refunded a pro-rata proportion of any fees already paid in advance in respect of such a student

 

IN THE EVENT OF CLASSES CANCELLED BY THE STUDENT, THE STUDENT WILL STILL LIABLE FOR FULL MONTHLY FEES AND THIS GIVES THE TEACHER THE RIGHT TO EXCUSE STUDENT FROM THE CLASS​

GENERAL INDEMNITY

The Academy and the Owners, Principal and Staff undertake to implement reasonable and generally acceptable safety and well being measures of all our students, educators and visitors to our Academy. Due to the nature of the matter, the Owner, Principal and Staff can however, not accept any responsibility for accidents that may take place in class, or on the academies terrain.

Each student/Parent/guardian is therefore requested to complete this form as proof that you accept the position of the Academy, Principal and Staff as set out above as well as the risks involved therewith.

I the (Student, Parent, Guardian) Indemnify Mitchell’s Plain Music Academy/Kraaifontein Academy of Music, the Owners, Principal and Staff for any losses or damages in general, however it may occur, that I as parent/guardian/student may suffer as a result of any occurrences whereby my child or myself (student) may be involved, whether as the causing or suffering party , whilst participating in any academic activity. In particular, I authorize that my aforesaid child or myself (student) may be involved in all excursions undertaken by the Academy during academic days as part of his/her/my learning experience and where applicable I agree the he/she/myself may utilize the transport arranged bY the Academy for such excursions. I also indemnify the Academy, Owner, Principal and Staff for damages or losses I as the parent/guardian/student as mentioned above may suffer under such circumstances and voluntarily accept the risk associated therewith.
